Welcome to ArrayPointer Technologies Pvt. Ltd. ("ArrayPointer," "Company," "we," "our," or "us"). By accessing our website, applications, software, or services, including our Shopify, BigCommerce, and mobile commerce applications, you agree to these Terms of Service.

1. Services

ArrayPointer provides software applications, ecommerce solutions, mobile app development, Shopify and BigCommerce applications, custom development services, integrations, consulting, support, and related digital services.

Our services may be offered through Shopify, BigCommerce, mobile applications, websites, marketplaces, and other third-party platforms.

2. Account Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials.

  • Providing accurate and up-to-date information.

  • Ensuring you have authorization to connect your ecommerce store and third-party services.

You remain responsible for all activities conducted through your account.

3. Subscription Fees & Billing

Some services require a paid subscription.

By installing or subscribing to our applications, you authorize billing through Shopify, BigCommerce, or other approved payment methods.

Subscription fees are non-refundable unless otherwise stated in writing or required by law.

ArrayPointer reserves the right to update pricing with reasonable notice.

4. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations.

  • Use our services to distribute harmful, misleading, or unlawful content.

  • Attempt unauthorized access to our systems.

  • Reverse engineer, copy, modify, or resell our software without written permission.

  • Disrupt the operation, security, or performance of our services.

5. Third-Party Services

Our services may integrate with Shopify, BigCommerce, Google, Meta, Klaviyo, payment gateways, logistics providers, and other third-party services.

ArrayPointer is not responsible for:

  • Platform outages or downtime.

  • Changes made by third-party providers.

  • Third-party fees, policies, or restrictions.

  • Data inaccuracies originating from third-party systems.

Your use of third-party services remains subject to their respective terms and policies.

6. Mobile App Publishing Services

Where ArrayPointer provides mobile app publishing services:

  • Approval of applications is solely at the discretion of Apple App Store and Google Play.

  • We do not guarantee approval, ranking, downloads, or revenue.

  • Changes to platform policies may impact app availability or functionality.

  • Merchants remain responsible for the content and legal compliance of their applications.

7. Intellectual Property

All software, source code, designs, documentation, trademarks, and proprietary technology developed or provided by ArrayPointer remain the exclusive property of ArrayPointer unless otherwise agreed in writing.

You receive a limited, non-exclusive, non-transferable license to use our services during your active subscription period.

8. Customer Data

You retain ownership of your store, customer, and business data.

You grant ArrayPointer permission to process such data solely for providing, maintaining, improving, and supporting our services.

Data handling practices are governed by our Privacy Policy.

9. Service Availability

While we strive for reliable service, we do not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable due to maintenance, updates, security measures, or circumstances beyond our control.

10. Limitation of Liability

To the fullest extent permitted by law, ArrayPointer shall not be liable for:

  • Loss of revenue or profits.

  • Loss of business opportunities.

  • Indirect, incidental, special, punitive, or consequential damages.

  • Loss of data resulting from third-party systems, platform changes, or user actions.

ArrayPointer's total liability shall not exceed the fees paid by the customer for the applicable service during the preceding twelve (12) months.

11. Indemnification

You agree to indemnify and hold harmless ArrayPointer, its employees, directors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:

  • Your use of the services.

  • Your store content.

  • Violation of these Terms.

  • Violation of applicable laws or third-party rights.

12. Termination

You may discontinue use of our services at any time.

ArrayPointer reserves the right to suspend or terminate services if these Terms are violated or if continued access poses operational, legal, or security risks.

13. Modifications to Services

We may modify, improve, suspend, or discontinue any feature or service at any time without liability.

14. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.
